Do I need to draw up a new will or trust in order to add the ATS Foundation to a bequest?

  • No. A document called a codicil or trust amendment can be used to include the ATS Foundation, Inc. to your existing will

What specific language is needed to make a bequest to the ATS Foundation?

You and your attorney can decide how you can make your bequest commitment. Provided below is sample language for your consideration:

  • Unrestricted Gift (a gift that can be used where the need is greatest): “I give to the ATS Foundation, Inc., a non-profit 501(c)(3) corporation (Tax ID# 20-2138855), headquartered in New York, NY, the sum of $_______ for its general purposes.”
    • TipUnrestricted bequests allow the ATS Foundation to use the funds where they are most needed.
    • Note: Because the ATS supports all of the Foundation’s administrative costs, no portion of your gift shall be used to cover the Foundation’s operational expenses, which include but are not limited to staff compensation and office rental space.
  • Gift for a Specific Purpose (a gift that can be designated): “I give to the ATS Foundation, Inc., a non-profit 501(c)(3) corporation (Tax ID# 20-2138855), headquartered in New York, NY, the sum of $_______ to be used for [state purpose].”
  • To gift a percentage of your estate: “I give to the ATS Foundation, Inc., a non-profit 501(c)(3) corporation (Tax ID# 20-2138855), headquartered in New York, NY,  _____ percent (%) of the rest, residue, and remainder of my estate (for its general purposes/to be used for [state purpose]).”

Do I have to tell the ATS/ATS Foundation about my bequest?

  • This is at your discretion. We encourage you to notify us of your intentions so that we may express our gratitude during your lifetime and include you as a member of the Edward Livingston Trudeau Society, which honors ATS members who have made legacy gifts.

Can I specify how my gift can be used?

  • Absolutely. You are welcome to identify the program areas that you would like to support directly. Please contact us first to ensure that the ATS Foundation can carry out your wishes.

What other tax benefits are available through bequests?

  • The ATS Foundation is a tax-exempt organization. All bequests we receive qualify for federal estate-tax charitable deductions, which can help reduce taxes that might be due upon death.

What other options are considered planned gifts?

  • You can name the ATS Foundation, Inc. as beneficiary of a savings account, insurance policy, or retirement plan. You can also add the name of the ATS Foundation, Inc. to a charitable trust during your lifetime. Learn more about these options.
